Welcome to Pacero. By downloading, installing, or using our GPS Running Tracker app, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

Acceptance of Terms

By using Pacero, you confirm that you are at least 13 years of age and agree to comply with these Terms. If you do not agree to these Terms, please do not use the app.

Description of Service

Pacero is a GPS-based running tracker application that provides:

• GPS run tracking and route recording
• Pace, distance, and time calculations
• Apple Health integration (optional)
• Training plans and analytics (Pro subscription)
• GPX export functionality

Subscription Terms

Free Features

Pacero offers a free tier that includes basic GPS tracking, run history, and Apple Health sync.

Pacero Pro Subscription

Premium features are available through Pacero Pro subscription:

• Monthly: $4.99 per month
• Yearly: $29.99 per year (save 50%)
• Free Trial: 3-day free trial for new subscribers

Billing

• Payment is charged to your Apple ID account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription in your App Store account settings

Free Trial

The free trial allows you to experience all Pro features for 3 days. If you don't cancel before the trial ends, you will be automatically charged for the selected subscription plan.

Refunds

All purchases are processed through the Apple App Store. Refund requests must be submitted directly to Apple through their refund process. We cannot process refunds directly.

User Responsibilities

When using Pacero, you agree to:

• Use the app in compliance with all applicable laws
• Not use the app while driving or in situations where it may be dangerous
• Pay attention to your surroundings while running
• Not reverse engineer, modify, or create derivative works of the app
• Not use the app for any illegal or unauthorized purpose

GPS Accuracy Disclaimer

GPS accuracy depends on many factors including satellite availability, weather conditions, and device hardware. Pacero uses advanced filtering to improve accuracy, but we cannot guarantee perfect precision. Do not rely solely on GPS data for critical navigation.

Health and Safety

Pacero is designed to assist with fitness tracking but is not a medical device. Before starting any exercise program:

• Consult with a healthcare professional if you have any health concerns
• Listen to your body and stop if you feel pain or discomfort
• Stay hydrated and run in safe environments
• Follow traffic laws and run facing traffic when on roads

Intellectual Property

Pacero, including its design, features, and content, is protected by copyright and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Limitation of Liability

Pacero is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app.

Changes to Terms

We may update these Terms from time to time. Continued use of Pacero after changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.

Termination

We reserve the right to terminate or suspend your access to Pacero at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions.
