Agreement to Terms

By downloading, installing, or using Pynqr ("the App"), you agree to be bound by these Terms of Service and End User License Agreement ("Agreement"). If you do not agree to these terms, do not use the App.

App: Pynqr - Network Discovery for iOS

1. License Grant

1.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on iOS devices you own or control
• Use the App for personal or business purposes on your local networks
• Access and use the App's features in accordance with these Terms

1.2 License Restrictions

You may NOT:

• ✗ Copy, modify, or create derivative works of the App
• ✗ Reverse engineer, decompile, or disassemble the App
• ✗ Remove, alter, or obscure any proprietary notices
• ✗ Rent, lease, lend, sell, or redistribute the App
• ✗ Use the App to violate any laws or regulations
• ✗ Use the App to access networks you don't own or have permission to scan
• ✗ Use the App to harm, harass, or attack others
• ✗ Attempt to gain unauthorized access to systems or networks
• ✗ Circumvent any usage limits or access controls
• ✗ Use automated tools to abuse or exploit the App

1.3 Ownership

The App and all intellectual property rights remain the exclusive property of Joeri Vanthienen. This Agreement does not grant you any rights to trademarks, service marks, or logos.

2. Acceptable Use

2.1 Authorized Use

Pynqr is intended for legitimate network discovery and security auditing purposes only:

Acceptable Uses:

• ✓ Discovering devices on your own home or business network
• ✓ Security auditing of networks you own or manage
• ✓ Network inventory and documentation
• ✓ Troubleshooting network issues
• ✓ Identifying unauthorized devices on your network
• ✓ Compliance auditing (GDPR, HIPAA, PCI-DSS, etc.)
• ✓ Educational purposes (learning about network security)

2.2 Prohibited Use

You may NOT use Pynqr for:

Illegal Activities:

• ✗ Scanning networks you don't own or have permission to scan
• ✗ Penetration testing without explicit authorization
• ✗ Hacking, cracking, or gaining unauthorized access
• ✗ Distributed denial-of-service (DDoS) attacks
• ✗ Network reconnaissance for malicious purposes
• ✗ Violating computer fraud and abuse laws (CFAA, etc.)

Unethical Activities:

• ✗ Invading privacy of others
• ✗ Stalking or harassment via network discovery
• ✗ Corporate espionage or competitive intelligence gathering
• ✗ Bypassing security controls without authorization

Abusive Activities:

• ✗ Excessive scanning that disrupts network performance
• ✗ Scanning public networks (coffee shops, hotels) without permission
• ✗ Circumventing free tier limits through deceptive means

2.3 Legal Compliance

You agree to:

• Use the App in compliance with all applicable laws and regulations
• Obtain proper authorization before scanning any network
• Respect the privacy and security of network owners and users
• Not use the App in any jurisdiction where network scanning is prohibited

3. In-App Purchases and Subscriptions

3.1 Pynqr Free Tier

The free tier includes:

• Limited network scanning
• Basic device discovery
• 1 export per month
• Standard security analysis

3.2 Pynqr Pro Subscription

The Pro tier includes:

• Unlimited network scanning
• Advanced discovery modes (Stealth, Comprehensive)
• Unlimited exports (CSV, JSON, PDF, XML)
• Enhanced security analysis
• TLS certificate inspection
• Passive evidence collection
• Priority support

3.3 Payment and Billing

• All purchases are processed through Apple's In-App Purchase system
• Prices are shown in the App Store and may vary by region
• Payment will be charged to your iTunes Account at purchase confirmation
• Subscriptions automatically renew unless cancelled 24 hours before renewal
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage subscriptions and turn off auto-renewal in Account Settings after purchase

3.4 Refunds

• All sales are final unless required by law
• Refund requests must be made through Apple's App Store
• We do not have access to process refunds directly
• Subscription cancellations do not result in refunds for the current billing period

3.5 Free Trial (if applicable)

• Free trials (if offered) require a valid payment method
• You will be charged automatically when the trial ends unless you cancel
• Cancel at least 24 hours before the trial ends to avoid charges
• Previous trial users may not be eligible for additional free trials

4. User Data and Privacy

4.1 Data Collection

Please refer to our Privacy Policy for detailed information about data collection, use, and storage.

Summary:

• All network scan data is stored locally on your device
• We never upload your scan results to our servers
• Purchase data is processed by RevenueCat for subscription management
• We do not collect personal information, analytics, or tracking data

4.2 User Responsibility

You are responsible for:

• Protecting your device and App data
• Backing up your scan data (if desired)
• Complying with data protection laws (GDPR, CCPA, etc.)
• Ensuring proper consent before scanning networks containing personal data
• Securing exported data files

5. Disclaimer of Warranties

5.1 No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• ✗ Warranties of merchantability
• ✗ Warranties of fitness for a particular purpose
• ✗ Warranties of non-infringement
• ✗ Warranties of accuracy, reliability, or completeness
• ✗ Warranties that the App will be error-free or uninterrupted

5.2 Security Analysis Accuracy

Pynqr provides security analysis and vulnerability detection based on network fingerprints and heuristics. We make no guarantee that:

• All vulnerabilities will be detected
• Security scores are accurate or comprehensive
• Device identification is correct
• The App will protect you from all security threats

You acknowledge that:

• Network security is complex and constantly evolving
• Pynqr is a tool to assist, not replace, professional security audits
• You are responsible for securing your network and devices
• We are not liable for security breaches or vulnerabilities on your network

5.3 Device Identification Accuracy

Device identification is based on network fingerprints, MAC addresses, and heuristics. We make no guarantee that:

• Device types are correctly identified
• Manufacturer information is accurate
• Operating system detection is correct
• All devices on your network will be discovered

5.4 Third-Party Services

We are not responsible for:

• Apple App Store availability or policies
• RevenueCat payment processing
• iOS system updates that affect functionality
• Third-party network devices or services

6. Limitation of Liability

6.1 Maximum Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THE APP IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS (OR $100 USD, WHICHEVER IS LESS).

6.2 Exclusion of Damages

WE ARE NOT LIABLE FOR:

• ✗ Indirect, incidental, or consequential damages
• ✗ Loss of profits, revenue, or business opportunities
• ✗ Loss of data or information
• ✗ Network downtime or performance degradation
• ✗ Security breaches or cyber attacks
• ✗ Legal liability arising from your use of the App
• ✗ Damages caused by your violation of laws or regulations
• ✗ Damages resulting from unauthorized network scanning

6.3 Basis of the Bargain

These limitations apply even if we have been advised of the possibility of such damages. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

7. Indemnification

You agree to indemnify, defend, and hold harmless Joeri Vanthienen, and our affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any laws or regulations
• Your unauthorized scanning of networks
• Your violation of third-party rights
• Any damage caused by your network scanning activities

8. Changes to the App

8.1 Updates and Modifications

We reserve the right to:

• Modify, update, or discontinue the App at any time
• Add, remove, or change features
• Change pricing for new subscribers (existing subscriptions honored)
• Require App updates to continue using the service

8.2 No Obligation to Update

We are not obligated to:

• Provide updates or bug fixes
• Add new features
• Maintain compatibility with future iOS versions
• Continue offering the App indefinitely

8.3 Discontinuation

If we discontinue the App:

• Active subscriptions will be honored until the end of the billing period
• No refunds for past payments
• You will be notified via the App or email (if available)

9. Termination

9.1 Termination by You

You may terminate this Agreement at any time by:

• Uninstalling the App from all your devices
• Cancelling your subscription (if applicable)

9.2 Termination by Us

We may terminate or suspend your access to the App immediately if:

• You violate these Terms
• You use the App for illegal or prohibited purposes
• We are required to do so by law
• We discontinue the App

9.3 Effect of Termination

Upon termination:

• Your license to use the App ends immediately
• You must uninstall the App from all devices
• All local data remains on your device (you can delete it)
• No refunds for active subscriptions
• These Terms survive termination where applicable

10. Intellectual Property

10.1 Ownership

All intellectual property rights in the App, including:

• Source code, algorithms, and software architecture
• User interface design and graphics
• App name, logo, and trademarks
• Documentation and help materials

...remain the exclusive property of Joeri Vanthienen.

10.2 Trademarks

"Pynqr" and associated logos are trademarks of Joeri Vanthienen. You may not use our trademarks without prior written permission.

10.3 Your Content

You retain ownership of:

• Network scan data stored on your device
• Custom device names, tags, and notes you create
• Exported reports and files

You grant us no rights to your content. All your data stays on your device.

11. Export Compliance

11.1 Export Control Laws

You agree to comply with all applicable export control laws and regulations, including:

• U.S. Export Administration Regulations (EAR)
• International Traffic in Arms Regulations (ITAR)
• European Union export controls
• Local export restrictions

11.2 Prohibited Destinations

You may not use or export the App to:

• Countries subject to U.S. trade sanctions
• Individuals on denied party lists
• Restricted end-users or end-uses
• Any jurisdiction where the App is prohibited

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of Belgium, without regard to conflict of law principles.

12.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts in Belgium for any disputes arising from these Terms.

12.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions, class arbitrations, or representative actions.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

13.2 Severability

If any provision is found to be unenforceable, the remaining provisions will remain in full force.

13.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms. We may assign these Terms to any affiliate or successor.

13.5 No Agency

These Terms do not create any agency, partnership, or joint venture relationship.

13.6 Force Majeure

We are not liable for failures due to circumstances beyond our reasonable control (e.g., acts of God, war, terrorism, pandemics, etc.).

13.7 Notices

We may provide notices to you through:

• In-app notifications
• Email (if you have provided it for support)
• Updates to these Terms (with notification)

13.8 Language

These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version prevails.

14. Changes to These Terms

14.1 Updates

We reserve the right to modify these Terms at any time. Changes will be effective:

• Immediately upon posting for new users
• 30 days after notification for existing users

14.2 Notification

We will notify you of material changes by:

• Updating the "Last Updated" date at the top
• Displaying an in-app notification
• Requiring acceptance before continued use (for major changes)

14.3 Acceptance

Continued use of the App after changes indicates acceptance of the updated Terms. If you don't agree, you must stop using the App.

16. App Store Terms

16.1 Apple Requirements

Your use of the App is also subject to:

• Apple's App Store Terms of Service
• Apple's Licensed Application End User License Agreement (if applicable)
• iOS Software License Agreement

16.2 Conflict with Apple Terms

In case of conflict between these Terms and Apple's terms, Apple's terms prevail for issues related to:

• Payment and billing
• App Store distribution
• iOS system requirements

16.3 Third-Party Beneficiary

Apple and its subsidiaries are third-party beneficiaries of these Terms. Apple has the right to enforce these Terms against you as a third-party beneficiary.

17. Acknowledgments

By using Pynqr, you acknowledge that:

1. Legal Responsibility: You are solely responsible for ensuring your use of the App complies with all applicable laws and regulations.
2. Authorization Required: You have obtained proper authorization before scanning any network you do not own.
3. No Professional Advice: The App provides information only and is not a substitute for professional security audits or legal advice.
4. Security Risks: Network scanning may pose risks, and you accept full responsibility for any consequences.
5. Data Accuracy: Device identification and security analysis may not be 100% accurate.
6. No Warranties: The App is provided "as is" with no guarantees of accuracy, reliability, or fitness for a particular purpose.
7. Terms Acceptance: You have read, understood, and agree to be bound by these Terms and our Privacy Policy.
